Notice - January 23, 2007
The national civil subpoena form (AO-88, located below) has been
updated to reflect the “electronic discovery” amendments
to the Federal Rules of Civil Procedure that took effect on December
1, 2006. The text of subdivisions (c) and (d) of Fed. R. Civ. P.
45 (Subpoena) is set forth at the bottom of the form to inform
a subpoena’s recipient of key provisions of the rule. The
updated form substitutes the newly revised language of subdivisions
(c) and (d), and it also adds the text of subdivision (e) (Sanctions)
to alert the recipient to the potential consequences of noncompliance
without adequate excuse.
