Proposed Local Rule Amendments
Call for Public Comments
October 16, 2018

 

At its September 2017 meeting, the Judicial Conference of the United States approved amendments to the Federal Rules of Civil and Criminal Procedure.  Those proposed amendments were adopted by the Supreme Court and transmitted to Congress in April, 2018.  These amendments are on track to take effect on December 1, 2018.  As a result of these impending national changes, the United States District Court for the Eastern District of Virginia is recommending adoption of several conforming amendments to our local rules, a few other amendments to bring our local rules into conformity with actual practice in our Clerk’s Office, and a few timing changes that promote consistency.  Below are redlined versions of the proposed amendments with a justification for each change, and a clean post-amendment version of such rule.

The amendments will take effect on December 1, 2018, subject to revision in light of any comments received, and absent any contrary Congressional action.  Interested parties may submit comments on the proposed amendments by U.S. mail or e-mail on or before November 11, 2018, to:

The Local Rules were last amended on April 17, 2018. At that time, Local Criminal Rule 12 was amended to reflect a change from eleven (11) to fourteen (14) days in the time allowed to file and respond to the listed pretrial motions, thus making the time periods consistent with those in Local Criminal Rule 47 (F) (1) as to the filing of the listed pretrial motions and responses thereto.
