Standing Order In Re: Procedures For The Filing, Service, And Management Of Highly Sensitive Documents (see 02/02/21 Amended Order)

In response to recent disclosures of widespread breaches of both private sector and government computer systems, the Judicial Conference of the United States has directed all federal courts to issue new security procedures to protect materials that contain highly sensitive information (“highly sensitive documents” or “HSDs”).  As such, the Standing Order entered today establishes which sealed documents are HSDs in the Eastern District of Virginia, and instructs Counsel and Pro Se Litigants how to file them.  The Order also explains how the Court on its own designates a document as an HSD, and explains how litigants may request that a document be designated as an HSD and removed from CM/ECF.
